Service Level Agreement

During the term of the agreement, the KPA & Co. LLP services will be operational and available to you on whole time basis in any calendar year, without the National Holiday and without the unavoidable circumstances which is beyond our control. While we strive to deliver services promptly, delays may occur due to departmental or regulatory processes. We are not liable for such delays.

Disputes and Jurisdiction

This Agreement shall all be governed and construed in accordance with the laws of India applicable to agreements made and to be performed in India. You agree that any legal action or proceeding between KPA & Co. LLP and you for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction at Kolkata only. Any cause of action or claim you may have with respect to the Service must be initiated within one (1) month after the claim or cause of action arises or such claim or cause of action is barred.

Compliances with Laws:

All users shall comply with all the applicable laws including but not limited to:

• Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by the Reserve Bank of India from time to time,

• Export Import Policy of the Government of India applicable to them respectively for using Payment Facility and the website.
